Care Arrangements and COVID-19
We are facing new challenges daily as a result of COVID-19, and for many, co-parenting is a huge part of that.
The Honourable William Alstergren, Chief Justice of the Family Court of Australia and Chief Judge of the Federal Circuit Court, has released guidelines to assist parents with navigating their way through the restrictions placed upon our society.
These guidelines include advice such as acting in the best interests of the children and their health; complying with Court Orders as far as practicable including acting cooperatively to set alternate changeover locations if school was previously nominated; facilitating communication between children and parents; and considering the health of those exposed to the children, including whether they are in a high risk category.
Whilst these guidelines are very useful for many, there are a significant number of parents who for a variety of reasons, are unable to reach agreement as to the genuine best interests of the children, are unable to engage in effective communication or negotiation, or sadly, parents who do not act in the best interests of their children.
The issues will exacerbate an already stressful time for children and families. We want to assure you that we are still open and here to help. We can assist with communicating and negotiating on your behalf, including determining whether behaviour of parents is sensible and reasonable, as far as the Court is concerned. We will always seek to resolve matters by consent, but if that is not an option, we have the back up of the Family Court and Federal Circuit Court to assist with these scenarios.
